BID NOTICE 

 

1. Main Scope 

. Project: Development of Korea Augmentation Satellite System (KASS) 

. Contract Period(Project Period): 61 Months from the effective date of Contract 

. Estimated Budget: USD 40,000,000.00 

. Delivery Term: DAP (INCOTERMS 2010) 

. Method of Contract: Limited competitive bidding (contract by negotiation) 

. Contents:  Development, implementation and establishment of KASS to provide APV-I service 

which consists of KRS, KPS, KCS KUS and GEO-satellite. 

 

2. Qualification of Bidders 

. Bidders shall be qualified under Article 12 (Requirements to Participate in Competitive Tender by 

Law) of the ENFORCEMENT DECREE OF THE ACT ON CONTRACTS TO WHICH THE 
STATE IS A PARTY.   

. Bidders shall have direct knowledge and experience in successfully developing and implementing a 

Satellite Based Augmentation System (hereinafter “SBAS”) as a Contractor. (The SBAS developed 
by Bidder shall be operating as present.)   

.  Bidders shall meet the foregoing qualification requirements and participate in the Bid 

Presentation.  

 

3. Bid Presentation and Distribution of the RFP Documents 

. Date, Time and Place of the Bid Presentation: July 27, 2016 14:00 p.m., Korean Local Time at 

the Meeting Room (2F) of the Industry Academia Research B/D (B/D #24) at KARI   

. Qualification of the Participants in the Presentation and the Documents to Be Submitted: 

- 

Evidence, documents and/or support materials to prove past experience (in development, 
implementation and establishment of SBAS) 

- 

Participation by a proxy: 1 copy of the power of attorney and the identification card of the proxy 
are required to be presented. 

. Distribution of the RFP:    The RFP Packages (hardcopy) shall be distributed to the Bidders 

satisfying the Bidders’ qualification requirements among the participants in the Bid 
Presentation. 

 

4. Submission of the Bidding Documents 

. Contents of the Bidding Documents: Bidder’s Proposal, Bid Value and Bid Bond shall be submitted 

by mail or in person prior to the Bid Closing Date. 

.  Date, Time and Place of the Bid Closing: August 30, 2016 14:00 p.m., Korean Local Time at 

the Procurement Team of KARI 

. Bid Currency: USD 

. Language of the Proposal: English 

. Submission by a proxy: 1 copy of the power of attorney and the identification card are required to be 

presented. 

. Contents of the Bid Proposal: Refer to the RFP with respect to details on the past experiences in 

development of SBAS and development plan of the KASS, etc. 

 

5. Payment of the Bid Bond and Its Reversion to National Treasury 

. Bid Bond: At least 5/100 of the total bid value (valid for 6 months from the date immediately 

preceding the Bid Closing Date, however, if the effective period of the Bid Proposal is extended, the 
valid period of the Bid Bond shall also be extended accordingly). 

. Currency of the Bid Bond: USD 

. Place and Deadline of Payment: To be submitted to the Procurement Team of KARI in the form of a 

surety bond issued by Seoul Guarantee Insurance Company or in the form of letter of credit through 
Woori Bank, Daejeon Branch (Add.: 29 Munye-ro, Seo-gu, Daejeon, 302-831 Korea, Tel:+82-42-
488-9704, Ext.312) prior to the Bid Closing Date (if such date is on a public holiday, the 
immediately preceding date). 

. Reversion to National Treasury: Bid bond shall be reverted to national treasury in accordance with 

Article 9 of the ACT ON CONTRACTS TO WHICH THE STATE IS A PARTY and Article 38 of 
its ENFORCEMENT DECREE. 

 

6. Nullification of Bid 

. This bidding may be nullified in accordance with Article 39(4) of THE ACT ON CONTRACTS TO 

WHICH THE STATE IS A PARTY and Article 44 of its Enforcement Decree.   

 

7. Selection of Successful Bidder (Selection of Qualified Bidders and 

Determination of Priority of Negotiation) 

. Unless otherwise specified herein, any necessary standards and procedures for the execution of the 

Contract shall be in accordance with the “Standards of Execution of Contract by Negotiation” (the 
Ministry of Strategy and Finance’s established rules on contracts) and the RFP. 

. According to the “Standards of Execution of Contract by Negotiation” and the RFP, both technical 

part and bidding price are evaluated. Through the evaluation, the Bidder who gets score exceeding 
eighty five percent (85%) of score in technical part will be selected as Qualified Bidder. And then, 
the Qualified Bidder’ technical part evaluation score and bidding price evaluation score are put 
together. Top scorer will be the Preferred Bidder and the Qualified Bidders will be selected based on 
the ranking of total score (if the total score is the same, the Bidder with higher score in technical part 
is preferred to others). 

. The total score of technical part is eighty (80) and the total score of bidding price part is twenty (20). 

. Please refer to the RFP for details of evaluation process.   

. The selected Preferred Bidder and Qualified Bidders will be given a notice stating the order of 

priority of negotiation, the negotiation schedule, etc. 

 

8. Remarks 

. The Bidder shall have a full understanding of all matters necessary for this Bidding including the 

RFP prior to making a bid and shall be responsible for any and all disadvantages arising from 
insufficient understanding of matters necessary for this Bidding. 

. Bidder shall prepare the Proposal in truth. In case that any content of the Proposal is founded to be 

false later, KARI may terminate or cancel the Contract even after the Contract is concluded.   

. Bidder shall provide the plan to get the government approval necessary for the development of 

Korea Augmentation Satellite System (KASS) in the Proposal.   

. All documents submitted in response to the RFP including the Proposal for this Bidding shall not be 

returned.  

. All expenses incurred by Bidder in connection with its Proposal for this Bidding are for its own 

account, and KARI will not disclose the evaluation result of Bidder’s Proposal. 

. If any Bidder is bankrupted or insolvent as of the date of this bid notice, such Bidder shall not be 

allowed to participate in this Bidding.   

. Bidders are required to keep confidential any data and information acquired in the Contract award. If 

any Bidder violates it, such Bidder may assume civil and criminal liability, sanction for improper 
businessman, and other disadvantages (such as penalty for security violation, subtraction of 
evaluation scores in future biddings, etc.). 

. If there is any conflict between the Korean version and the English version of this bid notice, the 

Korean version will prevail over the English version. 

. The RFP and other matters regarding this bidding shall be construed in accordance with and 

governed by the laws of the Republic of Korea. Any disputes in relation to, and under the RFP and 
this bidding shall be resolved through arbitration in Seoul, Korea under the Arbitration Rules of the 
Korean Commercial Arbitration Board.
